1. Agreement

These Terms of Use (“Terms”) govern your access to and use of The Conquer AMZ Academy (the “Program”), operated by Conquer ONL Pty Ltd (ACN 661 465 658, ABN 84 661 465 658).

By accessing, purchasing or using the Program, you confirm that you have read, understood and agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Program.

2. Eligibility

You must be at least 18 years old to use this Program.

By enrolling, you confirm that all information you provide is accurate and complete.

3. Program Access

Upon purchase, you are granted a personal, non-transferable, non-exclusive licence to access the Program content.

You agree:

  • Not to share your login details
  • Not to distribute, reproduce or resell any content
  • Not to allow others to access the Program using your account

We reserve the right to suspend or terminate access if these Terms are breached.

4. Account Responsibility

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your login details
  • All activity that occurs under your account

You must notify us immediately of any unauthorised use of your account.

5. Payments

All prices are listed in Australian Dollars (AUD) unless stated otherwise.

By purchasing, you agree to:

  • Pay all fees in full (or as per your payment plan)
  • Complete all instalments even if you stop using the Program

If you fail to make payments:

  • Your access may be suspended or removed
  • The outstanding balance may become immediately due
  • We reserve the right to engage a collections process if required

6. No Refund Policy

Due to the digital nature of the Program and immediate access to content, all sales are final and no refunds are provided.

By purchasing, you acknowledge and agree to this.

7. Chargebacks & Payment Disputes

You agree not to initiate any chargebacks or payment disputes without first contacting us.

If a chargeback is initiated:

  • Your access will be immediately revoked
  • You remain liable for the full amount owed
  • We reserve the right to provide evidence to dispute the claim
  • Any associated costs may be recovered from you where permitted by law

8. Results Disclaimer

We do not guarantee any specific results from participating in the Program.

Any examples of income, sales or success are:

  • Illustrative only
  • Not guarantees of performance

Your results depend on your own effort, decisions, experience and market conditions.

9. Educational Purpose Only

The Program is provided for educational and informational purposes only.

Nothing in the Program constitutes:

  • Financial advice
  • Legal advice
  • Business advice specific to your situation

You are responsible for seeking professional advice where required.

10. Intellectual Property

All content within the Program remains the intellectual property of Conquer ONL Pty Ltd, including but not limited to:

  • Videos, training materials and documents
  • Templates, frameworks and systems (including the Launchpad)
  • Any proprietary methods or strategies

You may not:

  • Copy, reproduce, distribute or share content
  • Use content to create or sell competing products
  • Share content with non-paying users
  • Publish or repurpose materials in any format

Any breach may result in:

  • Immediate termination of access
  • Legal action where necessary

11. Testimonials & Marketing Consent

By participating in the Program, you agree that:

  • Any testimonials, feedback, messages or results you share with us may be used for marketing purposes
  • This may include use on our website, social media, emails or advertisements

If you prefer your information not be used, you may notify us in writing.

12. Community Guidelines

If you participate in any community (e.g. Facebook group, WhatsApp group), you agree to:

  • Act respectfully toward other members
  • Not promote unrelated products or services
  • Not share confidential or proprietary information
  • Not solicit or poach other members

We reserve the right to remove access to community spaces at our discretion.

13. Third-Party Platforms

The Program may reference or integrate with third-party platforms (e.g. Amazon, Kajabi, Meta, Google).

We are not responsible for:

  • Changes to these platforms
  • Their policies, suspensions or decisions
  • Any losses resulting from their use

14. Prohibited Use

You agree not to use the Program or website:

  • For any unlawful purpose
  • To violate any laws or regulations
  • To infringe on our intellectual property
  • To distribute harmful or malicious content
  • To attempt to gain unauthorised access to systems or data
  • To copy, scrape or misuse content

We reserve the right to terminate access for any prohibited use.

15. Accuracy of Information

We make every effort to ensure information is accurate. However:

  • Errors or omissions may occur
  • We reserve the right to correct or update information at any time
  • We may cancel or refuse orders where necessary

16. Limitation of Liability

To the maximum extent permitted by law, Conquer ONL Pty Ltd, its directors, officers, employees, contractors and affiliates will not be liable for any indirect, incidental, special or consequential loss or damage, including but not limited to:

  • loss of profits, revenue or business opportunity
  • loss of data or goodwill
  • business interruption
  • loss of anticipated savings

arising out of or in connection with your use of, or inability to use, the Program or any content provided.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with these Terms or the Program is limited to the total amount paid by you for the Program.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

17. Indemnification

You agree to indemnify and hold harmless Conquer ONL Pty Ltd, its directors, employees and affiliates from any claims, damages, losses or expenses arising out of:

  • Your use of the Program
  • Your breach of these Terms
  • Any misuse of the content or services

18. Termination

We reserve the right to terminate or suspend your access if you:

  • Breach these Terms
  • Misuse the Program
  • Engage in harmful or inappropriate behaviour

No refunds will be provided in these cases.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

20. Assignment

You may not transfer your rights under these Terms without our written consent.

We may assign or transfer our rights at any time, including in connection with a sale of the business.

21. Privacy

Your use of the Program is also governed by our Privacy Policy.

22. Changes to Terms

We may update these Terms from time to time.

Continued use of the Program constitutes acceptance of any changes.

23. Governing Law

These Terms are governed by the laws of Australia.
